Terms of Service
1.Scope & Relationship to the Moxsend Terms
These Terms govern MoxWarm, the domain- and mailbox-warmup capability operated by [MOXSEND OPERATING ENTITY] as an integrated part of the Moxsend platform. MoxWarm is included with Moxsend plans and never sold separately; the Moxsend Terms of Service apply in full and prevail on conflict. [COUNSEL REVIEW: recommend consolidating into a master ToS with a MoxWarm service schedule]
2.The Service
MoxWarm builds sender reputation by exchanging automated, human-patterned warmup messages between your connected mailboxes and other consenting warmup-network participants, ramping volumes over an adaptive schedule (typically ~21 days), running inbox-placement seed tests, and continuously monitoring reputation signals with automatic throttling and pausing.
3.Mailbox Connection & Authorisation
- By connecting a mailbox (e.g., via Google or Microsoft OAuth), you authorise MoxWarm to send, receive, read, label, and move warmup messages within that mailbox for the purpose of the Service, and you confirm you are authorised to grant this access for the account and domain concerned.
- You must comply with your mailbox provider's terms; our use of provider APIs is subject to their policies, including the Google API Services User Data Policy (Limited Use). [COUNSEL REVIEW: verify OAuth scopes, Google/MS verification status, and Limited-Use compliance statements before launch]
- You may disconnect at any time; disconnection stops warmup for that mailbox and revokes our access token.
4.The Warmup Network
- Your connected mailboxes will send and receive warmup messages with other participants' mailboxes. Message content is synthetic, business-appropriate, and machine-generated; participation is mutual and proportionate.
- You must not inject marketing, solicitation, malware, or unlawful content into warmup traffic, harvest participant addresses, or contact network participants outside the warmup system. [COUNSEL REVIEW: network participant consent flow & inter-participant data terms]
5.Inclusion, Limits & Credits
Domains-warming allowances are set by your Moxsend plan (as published on the pricing page), with custom allowances by agreement. Ramp speeds, daily volumes, and placement-test frequency are set by the adaptive engine and may be throttled or paused automatically to protect reputation — yours and the network's. Any credit interactions follow the Moxsend Terms. [COUNSEL REVIEW / PRODUCT: reconcile plan-inclusion wording with the Moxsend pricing page before publication]
6.No Guarantees
Deliverability depends on your authentication records (SPF, DKIM, DMARC), sending behaviour, content, list quality, and mailbox-provider algorithms that change without notice. We do not warrant any particular inbox-placement rate, reputation score, ramp duration, or campaign outcome. Placement seed tests are indicative samples, not audits.
7.Your Obligations
- Maintain valid SPF/DKIM/DMARC for warming domains and refrain from sending practices that sabotage the ramp (e.g., blasting cold volume from a domain mid-warmup against engine guidance).
- Use warmed reputation only for sending that complies with the Moxsend Anti-Spam Policy; warming a domain in order to spam is a material breach.
8.Liability
The Moxsend liability framework applies, including the aggregate cap. Without limiting it, we are not liable for provider-side actions (filtering, blocklisting, account suspension by your mailbox provider), reputation outcomes, or consequences of mid-warmup sending decisions you take against engine guidance. [COUNSEL REVIEW: cap & carve-outs per governing law]
9.Suspension, Termination, Changes, Law
We may pause warmup immediately where signals indicate risk to shared infrastructure. Termination, amendments, governing law, and disputes follow the Moxsend Terms [GOVERNING JURISDICTION — COUNSEL REVIEW].
